CONTRACT OF ENGAGEMENT

1. Instructions

The advices furnished will be based on the instructions given by client and are solely for the benefit of the client and may not and should not be used for any other benefit or disseminated in any way without our prior written agreement and all advices furnished are reviewed by the Principal of he firm to ensure that the client's requirements are fully met.

2. Charges

In compliance with Section 68 of the Solicitors Amendment Act, 1994, a fee is set out in advance for the project work and submitted to the client for approval where possible. The basis of charge by which the professional costs are assessed include such fees as may be reasonable having regard to all of the circumstances of the case including the complexity, importance, difficulty, rarity or urgency of the legal questions raised, the professional skill, labour and responsibility involved and the specialized knowledge given or applied on the part of the Solicitor, the place wherein the circumstances in which the business or any part thereof is transacted and, the fee for professional time expended thereon. Such charges may include Court fees, Counsel fees, fees for medical examinations, reports and photographs, Rehabilitation Consultants reports together with the fees of other professional persons and all other necessary charges reasonably paid for or contracted by us as agents for client in pursuance of the business on hand. On completion of the case, a full and detailed bill will be submitted. Arrangements will be entered into with our client for interim payments and provision can be made if a client wishes to enter into an arrangement for ongoing weekly/monthly payments.

3. Confidentiality

All information is confidential unless disclosure is required by legislation.

4. File Storage

We store files for a period of six years from the completion of the project.

5. Communications

In the interest of speed and efficiency, we communicate with our clients by letter, fax and email. As email communications may not always be secure, please advise if you wish us to desist from contacting you by email with respect to your transactions.

6. Conflict of Interests

 If we believe that representation of you would involve a conflict of interest, then we would discuss the matter with you for the purpose of deciding on an appropriate course of action.
